Singer Mutoriah is set to take legal action against content creator Foi Wambui and Oppo Kenya after compensation talks regarding the alleged unauthorized use of his song ‘Beta’ in an Oppo Reno 12 5G marketing campaign failed.
Mutoriah had earlier sent a demand letter accusing Wambui and Oppo of using his song without permission in a social media promotion.
Despite attempts by Foi’s management and Oppo to settle the matter out of court, including a Sh50,000 offer, Mutoriah rejected the offer, stating it undervalued his work.
The amount offered doesn’t reflect the true value of his artistic work, considering that this is a violation of his intellectual property rights.”
Oppo denies involvement, citing that the campaign was handled by a third-party agency, as reported by Nairobi News.
Our client notes that it had an agency agreement with Alfluence (the advertiser) who later contracted the influencer.
Further, any approvals regarding the posting and/or actions related to your client’s allegations, do not stand against our client as it was not privy to the terms between the advertiser and the influencer.”
